Klanj\u010di\u0107 7a, OIB: 25935514944, 10000 Zagreb, Croatia<\/li><li>Web shop \u2013 website <a href=\"http:\/\/www.yestobeauty.spa\">yestobeauty.spa<\/a>, owned by the Seller<\/li><li>Wellness gift voucher \u2013 all services that is available on Web shop and which can be purchased through the Web shop<\/li><li>User \u2013 every person who visits or uses this website, regardless of registration<\/li><li>Customer \u2013 every person or company who place an order and\/or purchase a Wellness gift voucher via this website<\/li><li>Consumer \u2013 every natural person who enters into a legal transaction or operates on the market outside of his trade, business or professional activity, in accordance with the terms of the current Act on Consumer Protection of the Republic of Croatia.<\/li><li>Electronic delivery \u2013 delivery through electronic mail, to the Customer\u00b4s email address, which the Customer specified when ordering the Wellness gift voucher on the Web shop.<\/li><\/ul><p>By using the Web shop, the User confirms that he is aware of the fact that sometimes there may be service interruptions, or events that are beyond the Seller&#8217;s control, and accepts that the Seller is not responsible for any data loss that may occur during the transmission of information on the Web shop. The User agrees and accepts that access to the Web shop may sometimes be interrupted, temporarily unavailable or turned off.<\/p><p>The Seller can and reserves the right at any time, without prior notice, it it necessary, to cancel or change the content of the Web shop, the Privacy Policy, the Cookie Policy, the Purchase Conditions, the Wellness gift vouchers or their prices. Before each use of the Web shop, User is obliged to familiarize himself with the changes and content of the mentioned acts. The mentioned changes come into force on the day of publication on the Web shop.<\/p><p>The User is obliged to use the Web shop in accordance with the Purchase Conditions, Privacy Policy, Cookie Policy and applicable regulations. The Seller is released from any responsibility for damage that the User may incur through the use of the Web shop, due to illegal actions of third parties, computer viruses, interruptions in the communication line, unauthorized access, inappropriate behavior, negligence and other cases for which the Seller is not responsible.<\/p><p>Photography of products and services and other materials on the Webshop are informative and they try to portray the actual appearance of the product\/service as realistically as possible. Deviations in color and appearance are possible due to the way of photography, monitor settings, production time and improvement of products\/services, but they do not constitute the basis for any complaint, claim or exercise of other rights.<\/p><p>By using the Web shop, the User agrees to the application of Croatian law and positive legal regulations and the jurisdiction of the court in Zagreb, Croatia.<\/p><p>The Customer can only be an adult. Contracts can be concluded in the name and on behalf of minors and persons completely incapable of business by their legal representatives or guardians, and persons partially capable of business may conclude the contract only with the consent of their legal representative or guardian. By submitting the order, the Customer declares that he fully understands and agrees with the Purchase Conditions and that he has the appropriate business capacity to enter into a sales contract (i.e., that it has not been restricted or taken away from him).<\/p><p>The Customer is personally responsible for protecting the confidentiality of passwords, in places where they exist as such. The Customer is obliged to provide accurate, complete and valid personal data when ordering and\/or registering on the Web shop. Acting contrary to the above, authorizes the Seller to deny such Customer access to or the realization of all or part of the services offered on the Web shop.<\/p><p>Documents, data, photos and information published on this Web shop are protected by copyright and can only be used for personal needs and at the User&#8217;s own risk, with respect for all copyright and related or proprietary rights and rights of third parties in accordance with the positive legal regulations of the Republic of Croatia. Unauthorized use of Web shop content, without the permission of the copyright owner, is considered a copyright violation and is subject to legal action. This Web shop contains documents, data, information and links to other web pages created by third parties. The seller has no control over said documents, data, information or other Internet pages at all and fully disclaims all responsibility, including but not limited to the accuracy, completeness and availability of content on websites created by third parties.<\/p><p><strong>COMPLAINTS<\/strong><\/p><p>In accordance with the provisions of Article 10 of the Consumer Protection Act, the Seller enables the Customer to submit a written complaint. A written complaint can be submitted at the Seller&#8217;s business premises at the address Petrovaradinska 9a, 10 000 Zagreb, Croatia, or by post or via e-mail at <a href=\"mailto:info@yestobeauty.spa\">info@yestobeauty.spa<\/a>.<\/p><p>When the Seller recieves the written complaint, the Seller will confirm receipt without delay, and will declare to the Customer to validate complaint, within 15 days from the day of receipt of the written complaint.\u00a0<\/p><p>The Customer can also submit a written complain to the Seller through the platform for out-of-court dispute resolution, a the link <a href=\"https:\/\/europa.eu\/youreurope\/citizens\/consumers\/consumers-dispute-resolution\/out-of-court-procedures\/index_hr.htm\">https:\/\/europa.eu\/youreurope\/citizens\/consumers\/consumers-dispute-resolution\/out-of-court-procedures\/index_hr.htm<\/a>.<\/p><p>After filing a complaint through the out-of-court dispute resolution platform, it will automatically be forwarded to the Seller. If the dispute between the Seller and the Customer cannot be resolved by submitting a written complaint, the Seller may propose to the Customer to resolve the dispute out of court, before one of the bodies for alternative resolution of consumer disputes, in accordance with the provisions of the Act on Alternative Resolution of Consumer Disputes (Official Gazette 121\/16, 32\/19. If the Seller agrees to participate in the out-of-court dispute resolution process, it will propose one or more dispute resolution bodies that can handle the Customer&#8217;s complaint. Participation in the out-of-court dispute resolution process is not mandatory and depends solely on the consent of all parties to the dispute.<\/p><p>In the event that the Seller and the Customer do not resolve the dispute peacefully and\/or out of court, the court in Zagreb will be competent for disputes between the Seller and the Customer.<\/p><p><strong>RIGHT TO UNILATERAL CONTRACT TERMINATION<\/strong><\/p><p>The Consumer has the right to unilateral terminate the contract without giving reasons for the same. The Consumer has the right to terminate the contract within a period of 14 calendar days from the date of conclusion of the contract, if it was concluded outside the business premises of the Seller, i.e. at a distance. Before the expiration of the 14-day period, the Consumer must send a field form for unilateral termination, which is available <a href=\"https:\/\/yestobeauty.spa\/wp-content\/uploads\/2022\/09\/en-DA-LJEPOTI-WEBSHOP-OBRAZAC-ZA-JEDNOSTRANI-RASKID-UGOVORA-en.docx\" target=\"_blank\" rel=\"noopener\">HERE<\/a><strong>, <\/strong>to the email address <a href=\"mailto:info@yestobeauty.spa\">info@yestobeauty.spa<\/a>\u00a0The Seller will, without delay, confirm to the Consumer that he has received his statement on unilateral termination of the contract and will cancel the issued Wellness gift voucher and return the money, within 14 days from the date of receipt of the statement on termination of the contract.<\/p><p>NOTE: The Customer has no right to terminate the contract and refund if the Wellness gift voucher has been used.<\/p><p>There are certain situations in which the consumer\u2019s does not have the right to unilateral contract termination. For example, when:<\/p><ol><li>if the trader has fully performed the service contract, and the performance has begun with the consumer\u2019s prior express consent<\/li><li>if the subject-matter of the contract is the supply of goods or services for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader<\/li><li>if the contract concluded at a public auction<\/li><li>if the subject of the contract is the provision of services related to free time, if it is agreed that the service will be provided on a certain date or in a certain period.<\/li><\/ol><p>This Right to unilateral contract termination do not apply if the Customer is legal entity.
